BUSINESS LICENSES


In the interest of promoting health and general welfare of its citizens, the City of Carlsbad actively encourages and monitors business activities within the city boundary.  These activities are governed by Chapter 28, Licenses and Business Regulations, of the Code of Ordinances

Any person proposing to engage in business within the municipal limits of the city is required to register their business.  A separate registration is required for each outlet, branch or location within the city.   Registration can be accomplished either in person or by mail by submitting application to the Licensing & Permits Department.  However, business activities within the Farmers Market and Pawnbrokers are exempt from the registration but are subject to licensing under Articles IV and V of Chapter 29 of the Code of Ordinances.

The initial application for a business registration can be submitted anytime prior to starting the business and must include a $35 annual registration fee and a current revenue division taxpayer identification number or evidence of application for a current revenue division taxpayer identification number. Registration is subject to renewal prior to March 16 of each year.  The business registration fee will not be prorated for businesses conducted for a portion of the year.

Annual Registration Renewal.  No specific form is required for registration renewal.  At the end of the current calendar year the Licensing & Permits Department mails each registrant a reminder of the renewal requirement.  A new registration certificate is issued following verification of the information on file and payment of the $35 annual registration fee.

Temporary Business Registration.  A temporary business registration is available for itinerant vendors, crafters or others that may not desire an annual business registration.  The temporary business registration is issued, with one exception, in two week increments and for each outlet, branch or location within the city.  The "Christmas on the Pecos" is a month-long event for which a temporary business registration is available.  The cost of a Temporary Business Registration is $10 and is due when the application is filed with the city.

Business License.  The City of Carlsbad has adopted a special licensing procedure for business in the following categories: (1) Pawnbrokers, (2) Palmists, clairvoyants, fortunetellers, phrenologists, (3) Wrestling and boxing exhibitions and matches and all other athletic amusements, exhibitions or shows, (4) Circuses and carnivals. (5) Skating rinks, (6) Public dance halls and cabarets where regular dances are given, (7) Single dances [See Dance Permits] and (8) Shooting galleries.   A business desiring to undertake one of these types of businesses must request a Special License under Article II, Division 2, of Chapter 28 of the Code of Ordinances.  The application process requires the submission of a Special License Application, compliance with specific bonding requirements and payment of a $10 application fee in addition to registration of the business. A license for an enumerated business is subject to approval by the City Council and the business premises are subject to inspection by the City.

Solicitations.   Businesses desiring to make unsolicited contact within residential neighborhoods must request a Special License under Article VI of Chapter 28 of the Code of Ordinances.  Solicitation in violation of these provisions is a misdemeanor.  The application process requires the submission of a Special License Application, specific bonding requirements and payment of a $25 application fee in addition to registration of the business.  A peddler's identification card will be issued following a background check by the Carlsbad Police Department and approval of the City Council.  This identification card must be available at all times and presented upon request by any resident of the city or police officer. 

Special Use Permit. A home-based business or any business with minimal adverse inconsistencies with the use requirements of Chapter 56, Zoning, of the Carlsbad Code of Ordinances may request a Special Use Permit.  This permit is most often requested in residential zoning districts.  Following submission of an application and $10 application fee, the request is reviewed by the Planning and Zoning Commission and finally by the City Council.  This permit is issued to a specific applicant and will allow a temporary nonconforming use and is normally subject to specific standard conditions to assure maximum compatibility.
